SUMMARY OF THE ACT ON THE PREVENTION OF DISORDER AT SPORTS COMPETITIONS


Article 4

(1) For the purposes of this Act, the following shall be deemed unlawful behaviour:

  • possession or consummation of alcoholic and other beverages containing more than 6% of alcohol, narcotic drugs and possession of pyrotechnic devices, weapons or other objects suitable for causing bodily harm or creating disorder and violence,
  • attempt to introduce or introducing into sports facilities of alcoholic beverages, narcotic drugs, pyrotechnic devices, weapons and other objects which are, according to the steward's estimation, suitable for causing bodily harm or creating disorder and violence,
  • attempt to enter, entrance and staying in the area of sports facilities while intoxicated, with more than 0.50 g/kg of alcohol in blood, i.e. the corresponding amount of milligrams in a litre of exhaled air,
  • masking of face by a cap, scarf or otherwise for the purpose of concealing identity,
  • attempt to introduce, introduction and display of a banner, flag or another object containing a text, image, sign or other marking which expresses or incites hatred or violence based on racial, national, regional or religious affiliation,
  • throwing objects into the playing or the viewing area,
  • singing of songs or hurling of messages whose content expresses or incites hatred or violence based on racial, national, regional or religious affiliation, 
  • torching and throwing of pyrotechnic devices,
  • burning or destroying in another manner of supporters gear and other objects,
  • attempt to illicitly enter or illicit entrance into the playing area, the viewing area or the area intended for referees/umpires or other persons participating in the sports competition,
  • stay and lingering at a place within the viewing area for which the person does not possess an admission ticket or a corresponding document issued by the organiser,

(2) The unlawful forms of behaviour referred to in paragraph 1 of this Article may occur during the entire period from the departure and travelling, during the holding of the competition, until the return from the sports competition.

SANCTIONS

Article 31

(1) Sanctions for the misdemeanours stipulated by this Act shall be fine, prison sentence and protective measures, and for juvenile delinquents also educational measures.Participation in fights or physical assaults of spectators or other personsArticle 31a(1) Any person involved during the arrival to a sports competition, during a sports competition or leaving a sports competition in a fight or physical assault of other spectators, stewards, official persons of the organiser of a sports competition, athletes or other persons, and thereby causing severe bodily harm, shall be punished for such involvement by imprisonment of from three months to three years.

(2) If by the criminal offence referred to in paragraph 1 of this Article, the death of another person has been caused, the offender shall be punished for such participation by imprisonment for a term of from six months to five years.

(3) The organiser or leader of the group committing the criminal offence referred to in paragraph 1 of this Article shall be punished by imprisonment for a term of from one to eight years.

(4) The organiser or leader of the group committing the criminal offence referred to in paragraph 2 of this Article shall be punished by imprisonment for a term of from three to ten years.

(5) No criminal offence referred to in paragraphs 1 and 2 of this Article has been committed if the person who has participated in the fight has been involved in such fight without such person's guilt or only because such person has defended itself or separated the participants of such fight.

Organizing violence at sports competitions

Article 31b

Any person organising or leading the group of persons who together during the arrival to a sports competition, during a sports competition or during the return from a sports competition participates in a fight or assaults other spectators, stewards, official persons of the organiser of a sports competition, athletes or other persons, causing thus bodily harm to a person or damage or destruction of some person's object or property of higher value, shall be punished by imprisonment for a term of from one to five years.

Destruction of objects or property at sports competitions

Article 31c

Any person who during the arrival to a sports competition, during a sports competition or during the return from a sports competition damages, deforms, destructs or makes unserviceable other person's object or property of higher value, shall be fined or punished by imprisonment for a term of up to three years.

Article 39

(1) A fine in the amount from 265.00  to 2000.00 euros or a prison sentence lasting up to 30 days shall be imposed for a misdemeanour upon the natural person who:

  1. possesses or consumes alcoholic beverages and other beverages containing more than 6% of alcohol, narcotic drugs or possesses pyrotechnic devices, weapons and other objects suitable for causing bodily harm or creating disorder and violence (Article 4 paragraph 1 subparagraph 1),
  2. attempts to introduce or introduces into sports facilities alcoholic beverages, narcotic drugs, pyrotechnic devices, weapons or other objects suitable for causing bodily harm or creating disorder and violence (Article 4 paragraph 1 subparagraph 2),
  3. attempts to enter, enters or stays in the area of sports facilities while intoxicated, with more than 0.50 g/kg of alcohol in blood, i.e. the corresponding amount of milligrams in a litre of exhaled air (Article 4 paragraph 1 subparagraph 3),
  4. camouflages his/her face for the purpose of concealing identity (Article 4 paragraph 1 subparagraph 4),
  5. attempts to introduce or introduces and displays in sports facilities a banner, flag or another object containing a marking which expresses or incites hatred or violence based on racial, national, regional or religious affiliation (Article 4 paragraph 1 subparagraph 5),
  6. stays and lingers at a place within the viewing area for which he/she does not possess an admission ticket or a corresponding document issued by the organiser (Article 4 paragraph 1 subparagraph 11),

(2) A fine in the amount from 133.00 to 1330.00 euros or a prison sentence lasting from three days at the least to 30 days at the most shall be imposed for a misdemeanour upon the natural person, and a fine in the amount from HRK 5,000.00 to 30,000.00 upon the legal person that purchases or obtains in another manner or enables purchase or obtaining of admission tickets to a person to whom a protective measure (Article 32 paragraph 1), prohibition to attend the sports competition (Article 34a paragraph 1) and cautionary measure have been pronounced, and the organiser of a sports competition that does not proceed in line with the provisions of Article 32 paragraphs 5, 6 and 7 of this Act.

Article 39a

(1) A fine in the amount from 665.00 to 3320.00 euros or a prison sentence lasting from 30 days at the least to 60 days at the most shall be imposed for a misdemeanour upon the natural person who:

  1. throws objects into the playing or the viewing area of sports facilities (Article 4 paragraph 1 subparagraph 6),
  2. sings songs or hurls messages to competitors or other spectators, whose content expresses or incites hatred based on racial, national, regional or religious affiliation (Article 4 paragraph 1 subparagraph 7),
  3. torches or throws pyrotechnic devices (Article 4 paragraph 1 subparagraph 8),
  4. burns or destroys in another manner supporters gear or other objects (Article 4 paragraph 1 subparagraph 9),
  5. attempts to illicitly enter or illicitly enters the playing area, the viewing area or the area intended for referees/umpires or other persons participating in the sports competition (Article 4 paragraph 1 subparagraph 10).

(2) A fine in the amount from 665.00 to 3320.00 euros or a prison sentence lasting from 30 days at the least to 60 days at the most shall be imposed upon the person who has been pronounced the protective measure referred to in Article 32 of this Act but who has not proceeded in accordance with the provisions of Article 32a of this Act and who has been pronounced the prohibition referred to in Article 34a paragraph 1 of this Act but who has not proceeded in accordance with the provisions of Article 34a paragraph 2 of this Act .

(3) A fine in the amount from 665.00 to 6640.00 or a prison sentence lasting from 30 days at the least to 60 days at the most shall be imposed upon the natural person who has, within the period of two years before the day of committing the misdemeanour, been found guilty for the misdemeanours referred to in this Article two or more times on the basis of a legally final verdict.
